Sub: Regarding the settlement
of transfer under Rule 38 of P & T Manual Volume IV: Request for the display
of revised waiting list for RMS and MMS staff by rectifying the errors and
issue transfer order under rule 38.
Ref: 1. Your No. STA/50-1/R-38/2018 dated 29-08-2019 and circulation
of incoming list of Maharashtra Circle displayed on circle website vide no.
STA/50-1/Rule 38/2020 dated 24-09-2020.
Respected sir,
This is in continuation of this union communication dated
07-10-2019, 19-02-2020, 24-6-2020 and reference to your memo cited above. First
of all, this union is very much thankful to your honour for circulation of
incoming waiting list under rule 38 of P&T Manual Volume IV by displaying
on circle website on 24-09-2020. While going through the incoming list displayed
by the circle office on web site, this union has received various queries
related to the incoming list due to non-submission of updated or correct
information by some divisions/regions as below.
a. The name of
officials is still incorporated in the incoming list even though they were
already transferred as per order dated 31-12-2018, 29-08-2019 or by Mutual
transfer.
b. It is also brought
to notice of this union that till the date some regions/divisions have not
updated their incoming waiting list as per with applications done by the
applicant hence some discrepancies were observed in an order issued under Rule
38. There is still the wrong date of appointment mentioned against officials
& wrong date of application. (date of representation was mentioned as the
date of application in respect of some officials)
c. The waiting
incoming list/transfer order in respect of MMS drivers is not displayed till
the date even though there is an advertisement for recruitment against vacancy
issued by the administration.
d. Name of the same
Official is reflected double in waiting list. One by full name and second as
initial wise.
e. Name of some senior
officials is kept rank below the junior official even though he applied before
June 2020.
f. There are discrepancies
in the reason for the transfer. i. e. Family, Health/Spouse/Marriage.
g. There is a category
of the applicant is also different than the original category.
It is learnt that there are very few vacancies were declared for
the year 2020 (I.e. RMS B Division 5 vacancies, RMS L Division -2 vacancies and
RMS F division 2 vacancies) whereas there are a large number of vacancies
laying unfilled in each division. Non-holding of DPC in time for LSG, HSG-II
and HSG -I cadre is one of the reasons for non-reflection of correct vacancy
position.
Your honour is well aware that all applicants including cases
under spouse ground were waiting for transfer under rule 38 for more than 8
years. Now in this pandemic situation, all applicants want to live with their family
or their spouse. It is, therefore, requested to please consider all cases of
spouse ground as well as other cases as a special case one-time measure.
We urge your good self to look into the matter and give suitable
instructions to the staff section of Circle office for rectifying all issues
related to transfer under rule 38 incoming list at the earliest and issue
transfer order in respect of RMS and MMS staff at the earliest.
