Letter to CPMG : Regarding grant of special casual leave for DEC/DWC Meetings held by Divisional union.

Respected sir,

It has been reported to this union that some divisional heads are denied special casual leave for Divisional executive committee meetings held by Divisional union by misinterpretation of rules on the subject.

In this regard this union like to pay attention of your honour on para no. VIII of  DG Posts  compilation of instructions on matters concerning service association circulated vide No. 10-1/2004-SR dated 15th June, 2004. Where in clear instructions for Special Casual Leave for DEC Meeting at para no 1 to 3 of  of  DG No. 54-1/71-SPB-II dated 15.3.71.

Para no 4 of DG Posts54-19/59-SPB dated 31.08.59 and No. 54-13/71-SPB-II dated 31.01.74 states that “Special casual leave is not allowed to be combined with regular leave/EL or half pay levae etc. An understanding reached in the departmental council of JCM stipulated that as far as possible Divisional executive committee meetings of the service association will be held on holidays or outside office hours. As regards number of members attending the committee meetings the same will be accordance with the constitution. Where there is reason to believe that more members are asking for Special Casual Leave then justified , the constitution and the records of service association may be checked up to find out whether facilities have been asked for  more members than admissible under the rules.’’

In this regard it is stated that above instructions do not denied for grant of special casual leave for attending DEC meeting. Rules state that constitutions and record of union may be referred while granting Special casual leave. As per constitution of this union 15 office bearers and all branch secretaries are members of Divisional Executive Body are eligible for Special casual Leave i.e. President, 2. Two Vice president 3. Divisional Secretary, 4. Asstt Divisional Secretaries not exceeding eight 5. Treasurer 6. One organizing Secretary 7. An Auditor  and all branch secretaries.

The RMS and MMS divisions are functioned in three sets round ‘o’ clock in different offices and different stations. There is no fixed off or holiday to staff working at RMS and MMS offices. Hence special casual leave should be granted to all DEC members for attend Divisional Executive body meetings as per constitution of service association and guidelines on the subject.

It is therefore requested to kindly intervene in this matter urgently and give suitable instructions to all divisional heads for grant special casual leave for attendance of divisional Executive committee meetings for implementation of ruling in true spirit. I shall remain highly thankful to you for doing the needful.

Letter to CPMG : Regarding to make alternate arrangement of bigger and convenient place to function NSH ‘O’ Mile Nagpur smoothly.

Respected sir,

It has been reported to this union that, some portion of NSH Zero mile Nagpur is under construction since long. The construction work is badly affecting the work and function of NSH ‘O’ Mile. Due to shortage of space, temporary arrangement is made by the administration to carry out the work in open space behind the building. It is very serious to process the accountable and sensitive mail in open space without proper surveillance and supervision.
NSH Zero Mile is nowadays receive and process EP-COD, BP-COD  and very valuable articles from companies like Amazon, Snapdeal, etc. and the NSH is consist of 2-3 small rooms. It is not possible for any HSA/Supervisor to supervise the set from one place while doing his work especially when the valuable and EP-COD, BP-COD etc. articles are being processed for receipt dispatch in the set. It is worth to mention here that most of the receipt dispatch work depends upon the outsider coolies. Local union has raise an issue to fix the accountability and responsibility of outsider coolies but SRM office has neglected the issue with an eyewash reason that there are no guidelines in postal manuals to fix the responsibility of outsider coolies.
The operation of mails in open space creating extreme difficulties to the staff. Staff has to carry out the work in cold, low temperature throughout night. There is no arrangement of any computer in open operation area, the articles are scanned with cordless scanner attached to the computer inside building. It wastes double manpower for the same work. There is rush of the outsider peoples comes at booking counter NSH in the area throughout the day. Also mail motor pick up and drop of mail bags is also done in the same place. In all such circumstances there is high risk of loss or theft of valuable articles/public mail. Because, No supervisor can supervise the work properly in present situation. The small rooms in which the NSH is functioning are no longer useful to operate such a big unit like NSH. There is need of a big hall like most of the NSH, Mail offices in the department, thereby proper function, and proper supervision can be made.
Hence, there must not be two opinions two provide sensibly better working conditions to the staff by providing bigger and convenient place. Therefore, union demands to make alternate arrangement of bigger and convenient place to function NSH O Mile smoothly. This issue may please be handled on priority basis.
          It is therefore requested to kindly intervene in this matter urgently and give suitable instructions to appropriate authority for find out another premises can accommodate all functioning of NSH Nagpur for smooth and effective functioning. I shall remain highly thankful to you for doing the needful.

Following items are hereby submitted for the bio-monthly meeting of February-2016 for discussion.

Items:
1.     Regarding shifting of Computerized Registration Centre at Dadar HPO Building from CST Mumbai
Union Brief : It is brought to notice of your honour that earlier CRC work is functioning at Dadar HPO building very efficiently but administration has shifted the CRC work from Dadar to CST Mumbai which caused delay of public mail and conveyance problem. About 15000 registered mail in set/1 and 36000 Registered mail are being handled in Set/3 in altar net night duty where as bulk registration work is being processed at Dadar HPO Building. We propose to shift CRC Mumbai to Dadar for following beneficial points for speedy transmission of mail.
1.     The Dadar HPO Building is departmental building situated in heart of Mumbai  with best connectivity of all Zones i.e. A, B, C, D, S And New Mumbai
2.     Average Distance with all TMOs, APTMO, A Zone, Sion TMO, LTT, CST, Mumbai RMS, CTL TMO, Mumbai Fgn Post and PC Stg.
3.     In any situation the staff of Bulk CRC Dadar and Staff of CRC Mumbai can adjust work load present in Mumbai CRC and Bulk CRC due to functioning in one premise.
4.     All Zonal Post offices are in average distance for receipt and dispatch without traffic hurdle.
5.     It is centre place for all Mail Motor units i.e. Worli, Sion Koliwada , Airport and Mumbai GPO.
6.     There is sufficient space is available for accommodate CRC work at Dadar HPO building.
7.     For best connectivity of mail transaction, to overcome from traffic problem on road, better connectivity of all post offices, TMO, MMS and to improve KPI by speedy transmission of TD and NTD mail, the shifting of CRC Mumbai to Dadar HPO building is proposed. Your honour is requested to look into the matter and arrange to shift at the earliest.

2.     Stop booking of SAs for mail monitoring work at Airmail Sorting Division and allot the same to on duty ASPs/IPs.
Union Brief: A new practice of booking of SAs for mail monitoring work has been started recently. The mail offices are already facing shortage of manpower to manage the operative functions. In addition to this many of the officials are retiring day by day causing more shortage. Further the HRO has been forced to mandatory book full manpower in the set leading to increase in weekly off and non grant of leave on time. Hence this union requests to arrange to stop booking of SAs for mail monitoring purpose and allot the work to the on duty ASPs. While taken issue with divisional head SSRM AMSD has replied that there was need of special monitoring team in view of the complexity of the work handled by SPTMO (Inw) Staff. Therefore this arrangement was made which is proving beneficial as specific monitoring is being done. Lot of misconnections are getting avoided and overall performance of the Division is improved.  Reply of SSRM is not to the point as this work should be done by administration by deputing ASPos/IPos for effective mail monitoring not  by SAs. In this regard we hereby request to your honour kindly intervene in the matter and stop booking of SAs for mail monitoring and said work should be allotted to supervisory officers. i.e. IPOs and ASPOs for optimum utilization of Group C manpower during shortage of staff.

3.     Stop  irregular OT Orders to MMS drivers & RMS Staff and stop harassment by giving threats of disciplinary action towards non performance of OT
Union Brief : It is brought to notice of your honour that after fifth pay commission OT discontinued and Ota rates also not revised so far. As per motor vehicle act driver could not perform steering duty more than 6to 7 hours continuously but administration is still giving OT orders at per their will to MMS drivers.  The drivers were performing their duties under heavy stress and under threat of disciplinary action due to various show cause notices and unwarranted actions there of. We all aware that there is shortage of regular drivers and to overcome the problem, contractual/ daily rated drivers are engaged. Instead of ordering irregular OT duty to regular drivers staff sufficient contractual/ daily rated drivers can be engaged. In spite of orders from directorate regarding non awarding statutory punishment for non performance of OT duty, administration has neglecting the orders of directorate by misusing their powers. Now new recruitment has been done in MMS and there is no need of OT to drivers. It is therefore requested to please give suitable instructions to MMS authority to avoid OT orders to drivers beyond their physical capacity and rules on the subject.

Letter to PMG Mails & New Mumbai : Regarding decentralization of mail agency work Thane PO Line and Kalyan Po Line

            It has been reported to this union that due to centralization of mail agency of Thane Sorting Office and newly located Kalyan RMS causing delay of public mail as well as wastage of manpower. A copy of letter received by email from Divisional Secretary is attached herewith for your kind perusal.

            As per para No. 4 (b) of above order the mail agency of Thane Sorting and Kalyan RMS is centralized at newly located Kalyan RMS and  now facing problems of manpower, rehandling of processed mail, delay of public mail and  accounts bags to their post offices. There is no need of dispatch of bags from newly located Kalyan RMS which are already closed / processed for delivery Pos by Thane Sorting and other BPCs as it can be dispatched through mail agency at Thane Sorting at per earlier practice.

            It is therefore requested to kindly intervene in this matter urgently and decentralize the mail agency at the Thane Stg and newly located Kalyan RMS for smooth and speedy transmission of mail. I shall remain highly thankful to you for doing the needful.

Today i.e. 09-1-2016, e-Commerce Parcel Processing Centre located at Parel, Mumbai 400012 was dedicated to Nation by Shri Ravi Shankar Prasad, Hon'ble Minister of Communications and Information Technology. This centre is having capacity of handling of 30,000 parcels per day. Also having mechanized processing on conveyor belt with advance technical instruments.

THE PAYMENT OF BONUS (AMENDMENT) ACT, 2015
NO. 6 OF 2016                                                                         [31st December, 2015.]
            An Act further to amend the Payment of Bonus Act, 1965.
BE it enacted by Parliament in the Sixty-sixth Year of the Republic of India as follows:—
1. (1) This Act may be called the Payment of Bonus (Amendment) Act, 2015.

(2) It shall be deemed to have come into force on the 1st day of April, 2014.

2. In section 2 of the Payment of Bonus Act, 1965 (hereinafter referred to as the principal Act), in clause (13), for the words ‘‘ten thousand rupees’’, the words ‘‘twenty-one thousand rupees’’ shall be substituted.

3. In section 12 of the principal Act,—

(i) for the words ‘‘three thousand and five hundred rupees’’ at both the places where they occur, the words ‘‘seven thousand rupees or the minimum wage for the scheduled employment, as fixed by the appropriate Government, whichever is higher’’ shall respectively be substituted;

(ii) the following Explanation shall be inserted at the end, namely:—

‘Explanation.—For the purposes of this section, the expression ‘‘scheduled employment’’ shall have the same meaning as assigned to it in clause (g) of section 2 of the Minimum Wages Act, 1948.’

4. In section 38 of the principal Act, for sub-section (1), the following sub-section shall be substituted, namely:—

‘‘(1) The Central Government may, subject to the condition of previous publication, by notification in the Official Gazette, make rules to carry out the provisions of this Act.’’.

: Letter to The Secretary Department of Posts by General Secretary R3 : Regarding SHIFTING OF KALYAN RMS

Subject: Shifting of Kalyan RMS.
Respected madam,
It has been brought to the notice of this union by the Circle Secretary R-III & R-IV Maharasthra Circle that the Admnistration has ordered shifting of entire Kalyan RMS office (i.e. Registration, Parcel, Ordinary, Mail Agency Branch & SRO) except TMO to some proposed place in the interior of Thane City near Thane H.O. in our Departmental building. It is also learnt that the shifting is to be done before 4th  January, 2016. In this context the union would like to bring to your kind notice the following facts pertaining to developments near and around Kalyan RMS and benefits going to be earned by our Department through these developments in coming days. The few developments are illustrated below.
                 Kalyan RMS office is being conveniently located near the Central Railway corridors, which provides suburban connection to Mumbai, and inter-city connections to Post offices located in Dombilvali, Ulhasnagar, Kalyan, Ambernath, Badlapur, Karjat, and beyond. There is also a smooth passage to Panvel Stg through the Kalyan Shilphata road for faster connectivity.
                 The Kalyan railway station is a very important junction. From this junction, there is a bifurcation of railway lines i.e. Mumbai-Bhusawal-Nagpur line and the Mumbai-Pune line of the Central Railways. Kalyan is also known for being the Mumbai region’s exit station to North India and South India.
Moreover the distance between Kalyan RMS (which is serving delivery Post office located in and around Kalyan, Ulhasnagar, Dombivali, Ambernath, Badlapur, Kasara & beyond) and proposed place at Thane is 28 KM via NH3 Highway and will take almost 1 hour transit time for MMS Vehicle by road to reach Kalyan and later on further due transit time to reach the delivery POs.
In view of the above facts the union doesn’t find any merit in shifting of present office activities of Kalyan RMS to proposed place at Thane and further disturbing the mail agency functioning at Thane. Further shifting of Kalyan RMS to a place in Thane where already a Thane Sorting office is functioning has given rise to the apprehension of merger of both the offices in coming days as all the mail agency activities are being concentrated to the proposed office of Kalyan RMS at Thane. Possibility of such an action from the administration in future cannot be denied considering the past experiences and therefore the common interest of our staff is not protected in the said proposal and therefore the same remains insecure. Moreover when the TMO Kalyan RMS is to be retained at Kalyan Rly. Station and Department is paying the rent of this building to Railway then what is the need to shift Kalyan RMS to Thane Sorting building
We urge upon you to kindly advise CPMG Maharashtra Circle to convene a meeting with the Staff Side on this issue  and drop this proposal to  maintain cognizable atmosphere within the Circle.
