Subject: Regarding functioning of Mail Offices and Mail Motor
services provided during the lock down: The request for regularisation of
absentee period during the lockdown period.

Respected sir,
This is regarding the regularization of absentee
period during the lockdown period. This union has brought to notice that there
is no informality in settlement of absentee period during the lockdown period
or the divisional heads are not adhered guidelines given by the competent
authority.
Your honour is well aware that there is
transportation period and curfew under rule 144 announced hence no officials
can perform duty due to curfew and transportation issue. Initially, police
authority has not allowed any official for movement also there is no specific
orders regarding roaster duty or any other guidelines for attendance of duty.
In this regard your kind honours attention is invited on the instructions
issued on 19th May, 2020 by the honourable chief Postmaster General,
Maharashtra Circle after RJCM meeting held on administrative agenda on 15th
May, 2020. Where in at Para 4 (I) to (Iv) clearly defined how to regularize the
absentee period. But it is regretted to say that divisional heads are not
adhering guidelines given by the CO Mumbai above.
In this regard, CO Mumbai has clearly instructed
that staff not assigned office duty as per roaster will be treated as on duty
working from Home means the period till the commencement Roaster duty. I.e. If
the roaster duty started on 28th April 2020 then 23rd
March to 4th May, 2020 may be treated as duty or work from Home
because they have not assigned duty as per roaster or roaster was not introduced.
Secondly, when the official remained absent for duty on his roaster duty then
his leave should be obtained for the period of absentee to actual joining of
his duty or roaster duty only.
Similarly, when the competent authority has directed
to official to remain home quarantine/isolation and shall not attend the office
duty under any circumstances and for they shall treated as duty work from Home.
It is also instructed in C.O. instructions dated
19-05-2020 that in para No. 5 that any staff or his family member residing with
him also develops influenza-like symptoms then the staff should inform his
divisional head compulsorily and apply for commuted leave with or without a medical
certificate. Other sick staff may apply for leave as usual. Whereas divisional
heads are now forced to staff to submit backdated medical fit and unfit
certificates for regularization of commuted leave applied without a medical
certificate after 4th April 2020 which in contradictory of
guidelines dated 19-05-2020 hence it is requested to give suitable instructions
to divisional heads to consider all commuted leave without medical certificates
as per CO order.

again invited on the GOI, MOC & DOP No.
Z92011/25/2020-Coord/O and M dated 15-07-2020 wherein clearly stated that the Persons
with Disabilities (Divyangian) are exempted from roaster duty i.e. all period
should be treated as duty work from Home. MHA & MOHW has time to time
instructed that the pregnant women’s and employee having children below 5 years
may be exempted from duty and should be treated as duty work from home. It is,
therefore, the absentee period in respect of pregnant women’s as well as whose children
below 5 years may also please treat as duty work from home till the date of
discontinued of roaster duty.
Now GOI, MOC & DOP No. 21-04/2020-SPG dated 11-08-2020 has circulated
the instructions regarding the absentee period in respect of officials who are
on leave or out of head quarter due to various circumstances may please considered
accordingly because interstate railway stared on 12th July 2020
where in inter district transport
started recently. Hence absentee period may please be regularized accordingly.
It is therefore urged look
into the matter personally and requested kindly give suitable instructions to
all divisional heads including Senior Manager, MMS Mumbai to regularize all
leave cases in true spirit. We shall remain highly thankful to you for doing
the needful.
