DOP&T APPROVED AGENDA ITEMS FOR STANDING COMMITTEE NATIONAL COUNCIL JCM TO BE HELD ON 03.05.2017.

The DOP&T has now circulated the following agenda items for discussion in the Standing Commitee meeting of the National Council JCM scheduled to be held on 3rd May 2017.It is understood that regarding the agenda items relating to Ministry of Health and Department of Pension (which is not included in the notified items) , these two Departments may hold seperate meetings with the Standing Committee. Other items including those related to 7th CPC etc are not included in the notified items.

ALLOWANCES COMMITTEE SUBMITTED ITS REPORT TO UNION FINANCE MINISTER

The Committee on Allowances headed by Shri Ashok Lavasa, Finance Secretary and Secretary (Expenditure) submitted its Report to the Union Finance Minister Shri Arun Jaitley yesterday; The Report will be now placed before the Empowered Committee of Secretaries (E-CoS) to firm-up the proposal for approval of the Cabinet. 

The Committee on Allowances, constituted by the Ministry of Finance, Government of India to examine the 7th CPC recommendations on Allowances, submitted its Report to the Union Finance Minister Shri Arun Jaitley yesterday. The Committee was headed by Shri Ashok Lavasa, Finance Secretary and Secretary (Expenditure),M/o Finance, Government of India and had Secretaries of Home Affairs, Defence, Health & Family Welfare, Personnel & Training, Post and Chairman, Railway Board as its Members and Joint Secretary (Implementation Cell) as its Member Secretary.

The Committee was set-up in pursuance of the Union Cabinet decision on 29.06.2016 when approving the 7th CPC recommendations on pay, pensions and related issues were approved. The decision to set-up the Committee was taken in view of significant changes recommended by the 7th CPC in the allowances structure and a large number of representations received in this regard from various Staff Associations as well as the apprehensions conveyed by various Ministries / Departments. The 7th CPC had recommended that of a total of 196 Allowances, 52 be abolished altogether and 36 be abolished as separate identities by subsuming them in another allowance.


The Committee took note of all the representations received from various stakeholders on the 7th CPC recommendations on Allowances. Representations and demands for modifications were received in respect of 79 allowances which have been examined in detail by the Committee. In doing so, the Committee interacted with all the members of the Standing Committee of National Council (Staff Side), Joint Consultative Machinery (JCM) as well the representatives of various Staff Associations of Railways, Postal employees, Doctors, Nurses, and Department of Atomic Energy. It also interacted with the representatives of the Defence Forces, DGs of Central Armed Police Forces (CAPFs) namely CRPF, CISF, BSF, ITBP, SSB, and Assam Rifles as also senior officers from IB and SPG to understand the viewpoint of their personnel.  As mentioned in the Report, the Committee held a total of 15 meetings and was assisted by a Group of Officers headed by Additional Secretary (D/o Expenditure) in examining the representations. 


Based on such extensive stakeholder consultations and detailed examination, the Committee has suggested certain modifications in the 7th CPC recommendations so as to address the concerns of the stakeholders in the context of the rationale behind the recommendations of the 7th CPC as well as other administrative exigencies. Modifications have been suggested in some allowances which are applicable universally to all employees as well as certain other allowances which apply to specific employee categories such as Railway men, Postal employees, Scientists, Defence Forces personnel, Doctors and Nurses etc.


The Report, now being examined in the Department of Expenditure, Ministry of Finance, will be placed before the Empowered Committee of Secretaries (E-CoS) set-up to screen the 7th CPC recommendations and to firm-up the proposal for approval of the Cabinet. It may be recalled that while recommendations of the 7th CPC on pay and pension were implemented with the approval of Cabinet, allowances continue to be paid at old rates. After consideration by the E-CoS, the proposal for implementation of 7th CPC recommendations on Allowances after incorporating the modifications suggested by the Committee on Allowances in its Report shall be placed before the Cabinet for approval.

Action Taken Statement of Standing Committee and National Anomaly Committee after 6th CPC

CADRE RESTRUCTURING IMPLEMENTATION DEFERRED

Today on dated 25th April-2017, Com. R.N. Parashar Secretary General NFPE & General Secretary P-III alongwith Com. Giriraj Singh, President NFPE & General Secretary, R-III met with Shri B.V. Sudhakar, Secretary (Posts) and discussed issues of Cadre Restructuring and appraised him the difficulties being faced by the staff and requested either to modify the Cadre Restructuring as per suggestions submitted by NFPE & P-III or defer till the issues are settled. Secretary called DDG (Estt) Smt. Smriti Sharan & Director Estt. Shri S.V. Rao and ordered to form a committee of officers of Directorate which will take views of all Chief PMGs and after that Convening a meeting with unions, issues will be settled. Till then he ordered to keep the Cadre Restructuring implementation in abeyance

 Respected Sir,

          With reference to your above cited letter on the even subject. It is observed that the administration has taken steps since last one year for the systematic closure/ abolition of Thane Sorting or Kalyan RMS. Hence, we strongly protest for the abolition of Thane Sorting or Kalyan RMS as the case may be. As the one mail office is being functioning at another city is not understandable and it seems it is closure or abolition of one RMS office.   But since the administration has sought the views from union, hence this union would like to submit the following views/demands for your kind consideration while finalising the merger of Thane Sorting with Kalyan RMS at Thane.

  1. There is one post of SRO (HSG-II) in Thane Sorting and one tenure post of OA in SRO Thane Sorting. The SRO (HSG-II) is a promotional post for our Group-C and the same needs to be redeployed after merger for its optimum utilisation. Our Divisional Union of Central Sorting Division, Mumbai is continuously requesting the Divisional administration to provide one SRO at Sion TMO office to look after the operational & service related issues of the staff working in Sion TMO Office. Presently there are approx. 50 number of Staff (both Gr-C & MTS) working in Sion TMO and hence it is requested to kindly create new establishment of SRO Sion TMO instead of merging of SRO Thane into Kalyan RMS redeploy the post of SRO (HSG-II) alongwith one OA to Sion TMO office during merger.
  2. Secondly, the additional post of OA may be redeployed to SRO, Kalyan RMS at Thane to manage the additional work load.
  3. One Post Office Extension Counter was attached to Thane Sorting office which may kindly be surrendered to Thane Central Division as the building is to be vacated post-merger.
  4. One Gr-C staff is also provided from Thane Sorting to Thane BPC and 2 Gr-C staffs are provided from Kalyan RMS at Thane to Kalyan BPC. With the merger, the work load of Kalyan RMS at Thane is going to increase considerably. Hence this union requests to withdraw the staff from both the BPCs and provide the same to Kalyan RMS at Thane. This union would also like to point out that few of the Postal Assistants are working on deputation in Central Sorting Division which may be redeployed to both the BPC for causing relief arrangement of our Gr-C staff.
  5. All the Gr-C & MTS staff of Thane Sorting should be attached to Kalyan RMS at Thane post merger.
  6. The merger of Thane Sorting with Kalyan RMS at Thane should cause some relief to the staff and for this some of the long pending Rule-38 cases of Central Sorting Division should be cleared and necessary orders for relieving the concerned staff should be issued.
  7. The MGMMT on the Mail Motor Trips (i.e. KY-2, KY-3, KY-4, KY-5 and KY-8) are presently provided by Thane Central Division (i.e. the Postal Division). Whereas the MGMMT for K-1 & K-3 Trips are provided by Thane Sorting Office (i.e. RMS office). After merger it is requested to kindly arrange deployment of MGMMT on all the Mail Motor Trips attached to Kalyan RMS at Thane from SRO Kalyan RMS at Thane so as enable uniform control on all the Mail Motor Trips and optimum utilisation of existing manpower.
  8. With merger, this union requests to attach the work of registered mail pertaining to Thane district/ TSO to CRC Kalyan RMS/ PH Kalyan RMS at Thane which is presently being done at CRC Mumbai/PH Mumbai.

This union hopes for positive consideration of above views/demands while finalising the merger of Thane Sorting Office with Kalyan RMS at Thane.

Respected Sir,

Following items are hereby submitted for the four-monthly meeting of April-2017 for discussion.

Items:
1      Construction of Panaji Stg in bricks instead of iron sheet walls and provision of basic amenities to staff:-
UNION BRIEF:  Panaji sorting office (Goa) is NSH, CRC, L-1 office having good revenue under BD and receiving lot of mails. Panaji sorting office office was at Panaji city but it was shifted from Panaji city to Alto Porvorim in Postal Colony. Initially small iron sheets rooms were provided after continuous follow up and items taken with R.O. Panaji in Sept. 12 the then PMG has agreed to construct building but Local Municipal authority has raised some technical problems for Building construction permission hence for time being considering urgencies (temporally) a  extension  to these rooms were made but it is of tin sheets rooms i.e. Iron pillars and all sides are covered with iron sheets, (no brick wall) and the roof also of iron sheets which are inconvenient. A Goa state is hot climate place which make the room into a hot pot. (though fans are provided).  Goa is under heavy rain fall state and rain drop falls on Tiny roof and create very big noise. Secondly rooms for the ladies is provided outside of these rooms. During night duty ladies could not find convenient to go every time outside office for famine purpose or Tiffin purpose because some time street light goes off and there is fear of reptiles and stray dogs in the premises. Hence it is a demand to make provision of ladies room in the building itself  of Panaji stg. This issue pending with honourable PMG Goa since 2012 and  issue is again raised with Supdt. RMS BM Div. Miraj again June  2016 and in subsequent meetings. It is replied that matter is taken with R.O. Panaji and estimate will be taken and civil wing will be addressed.

             It is requested to provide proper building having Brick walls and with Proper roof. Or provide space for Panaji sorting office in new under construction building near ST Stand Panaji at Patto Panaji.


2. Counting the period of pre-appointment training period/induction training period for MACP Promotion in Maharashtra Circle.

Union Brief :     It is brought to notice of this union that pre-appointment period /induction training period is not counted for the purpose of MACP promotion in Maharashtra Circle. In this regard, I wish to share the following on the counting the period of Induction and practical training for MACPS in the Department of Posts. Hitherto the training period has not been considered for the grant of promotion under MACPS. On perusal of the rulings on the subject, it seems that the period of training is to be considered for MACPS also. Whereas some circles are counted the training period for MACP promotion but not implemented in our circle.

            A kind reference is invited to the following orders on the subject.                     
           1.Dte letter no 4-7/(MACPS)/2009-PCC dt 18.9.2009

2. Dte letter no 4-7/(MACPS)/2009-PCC dt 23.6.2016

            All the candidates selected for PA/SA cadre are to undergo Induction and practical training for 90/105 days, before regular appointment.

1.      Such period of training was not counted for anything and their pay and allowances, increments were regulated from their actual date of joining in the department as Postal Assistants/ Sorting Assistant.

2.      Subsequently, orders were issued for counting the training period for increments and for the promotions (financial upgradations) under TBOP and BCR schemes, vide Dept. of Personnel and Trg OM 16/16/92-Estt( pay I) dt 31.3.1992.

3.      The above provision was made applicable with effect from 1.1.1986. The pay of the officials was notionally fixed from 1.1.1986 to 30.9.1990 and on actual basis from 1.10.1990.

4.      The above provision was applicable to those officials who underwent training on or after 1.1.1986.

5.      The provision was extended to officials who underwent training before 1.1.86 vide Dte order number: 44-2/2011-SPB II dated 5.5.2016.

6.      The scheme of MACPS was introduced consequent on the implementation of 6th CPC with effect from 1.1.2006.

7.      This scheme was given effect from 1.9.2008 vide reference cited under 1 above.

8.      The salient features of the scheme were given in the Annexure-I to the communication cited under 2 above.

9.      The second sentence of para 9 of the Annexure read as follows: “Service rendered on adhoc/contract basis before regular appointment or pre-appointment training shall not be taken into reckoning. A casual reading of the text gives the meaning that the pre-appointment training shall not be taken into reckoning. Under this context, the training period was omitted for the grant of MACP to the officials, it is presumed.

10.  But a close reading of the above text gives a different but correct meaning. The meaning of the above text may be explained as follows. If the sentence is broken into smaller parts, they read as follows.

a.      Service rendered on adhoc/contract basis before regular appointment shall not be taken into reckoning.

b.      Service rendered on adhoc/contract basis before pre-appointment training shall not be taken into reckoning.

11.  From (a) and (b) above only the service, if any, rendered on adhoc/contract basis either before regular appointment or before pre-appointment training shall not be taken into reckoning.

12.  From the above it is clear that pre-appointment training shall count for MACPS, as the above text speaks only about the services rendered on adhoc or contract basis which might before regular appointment or before pre-appointment training, and nothing about the training period.

13.  As per the communication cited under 2 (I.e. clarification dated 23.06.2016)  above, the second sentence of para 9 is modified as follows: “service rendered on adhoc/contract basis before regular appointment on pre-appointment training shall not be taken into reckoning.”

14.  From the above, it is clear that any service rendered on adhoc/contract basis will not count, but the training period counts for the grant of promotion under MACPS. It is added that as per our departmental rules, the training period is neither treated as service on adhoc basis nor on contract basis in as much as this period counts for increment.


16. Accordingly, the pre appointment training period is being calculated in other circles i.e. Andra Pradesh Circle Copy attached.

17.  It is added that just like TBOP/BCR schemes, MACPS is also a financial upgradation only. Hence the provision of counting training period towards TBOP/BCR will squarely applicable to MACPS also.

It is therefore requested to your honour that kindly look into the matter advice to all regions for count the pre appointment training period for the purpose of MACP promotion or sought clarification from the directorate on the subject.

Union Brief:  It is brought to notice of your honour that there are number of cadres in MMS division and due to acute shortage of staff in various cadres all MMS Divisions are paralyzed and not woring smoothly due to non fill up the posts your honour is requested to take initives for filling up all vacant posts for moth functioning of all MMS Divisions..
