Regarding transfer under rule 38 in RMS Divisions.

Respected sir,

          This is in continuation of this union correspondence dated 25-11-2017 regarding the settlement of all transfer under rule 38 of P&T Manual Volume IV in Maharashtra circle. This union is very much thankful to your honour for display of central waiting list of rule 38 transfer our circle website.

          In this regard, it is brought to notice of your honour that various divisional head has recommended some candidates who apply for transfer under rule 38 but some divisional head has not recommended for transfer without giving any reason or giving reason of shortage of staff and some divisional head has recommended transfer by giving reason subject to provision of substitute.

          In this regard, it is brought to notice of your honour that as per guidelines on the subject, all rule 38 cases should be reflected while declaring the vacancies for the particular year but unfortunately it seems that there is no divisional head, as well as  circle/regional office, has taken in account the rule 38 cases while declaring vacancies for recruitment.
                                                                                     
The cases of husband and wife at same station cases may be settled at the priority basis but the cases of reason for taking care of their old age parents or other reason may also be considered as there is social responsibility of every son or daughter to take care of their parents also and straightway not recommendation of these cases is not fair.  It is therefore requested to direct all divisional head to recommend all cases irrespective of any reasons who fulfil the basic conditions for transfer under rule 38. They could not be deprived of their facility under rule 38 transfer given by the ruling on the subject. Now new candidates recruited for the year 2014, 2015 are resumed their duties and recruited candidates for the year 2016 will also resume their duty soon. This union has not taken any objection for college students or outsiders in a live shortfall in SA cadre to cope up of work hence there is no problem to consider all cases of transfer under rule 38 in respect of RMS division.

Your honour is, therefore, urged look into the matter personally and cause to release all officials who are recommended by the divisional head for transfer under rule 38 and also settle all remaining rule 38 transfer cases in RMS divisions at the earliest. Your reply in this regard is highly solicited.
